La Ley Orgánica de Protección de Datos Personales y Garantía de los Derechos Digitales (LOPDGDD), aprobada a finales de 2018, inauguró nuevos espacios de actuación de los representantes colectivos del personal laboral que permiten acotar el amplio margen que puede derivarse de un uso ilimitado y/o abusivo de los datos personales de los trabajadores por parte de la empresa. Partiendo de la legislación relativa a los derechos de información y consulta existente antes de la aprobación de dicha ley orgánica, se valorará la novedad cualitativa que representan esos otros derechos en cuanto a garantía y reserva del derecho a la protección de datos. El trabajo se enfoca a situaciones concretas en las que la empresa utiliza dispositivos digitales para controlar la actividad laboral, o en las que accede a los dispositivos facilitados al trabajador para realizar su prestación de trabajo. La regulación jurídica de la grabación de imágenes en las que se capta al trabajador en “comisión flagrante de actos ilícitos” ocupará asimismo un lugar destacado en las páginas siguientes. En tanto que la información previa que se analiza en este trabajo es parte del contenido esencial del derecho a la protección de datos, el juicio de proporcionalidad de la medida empresarial contará también con nuestra atención. En breve, el trabajo pretende poner de relieve el alcance del deber de información previo ínsito en el derecho de protección de datos, deber que en la ley española se proyecta sobre los trabajadores y sus representantes.
The Organic Law on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), passed at the end of 2018, inaugurated new spaces of action for the collective representatives of the labour staff that allow to limit the wide margin that can derive from an unlimited and/or abusive use of the workers' personal data by the company. Starting from the legislation on the rights to information and consultation existing prior to the approval of this organic law, the qualitative novelty represented by these other rights in terms of guaranteeing and reserving the right to data protection will be assessed. The work focuses on specific situations in which the company uses digital devices to monitor work activity, or in which it accesses the devices provided to the worker to carry out his or her work. The legal regulation of the recording of images in which the employee is caught in the "flagrant commission of illegal acts" will also figure prominently in the following pages. As the prior information analysed in this paper is part of the essential content of the right to data protection, the proportionality of the employer's measure will also receive our attention. In short, the paper aims to highlight the scope of the duty of prior information embedded in the right to data protection, a duty that in Spanish law is projected onto workers and their representatives.
