Este trabajo analiza de forma crítica la fiscalidad del autoconsumo eléctrico de fuentes renovables en España, examinando las figuras tributarias que gravan esta realidad y proponiendo medidas que respondan de manera más eficiente a la finalidad de protección del medio ambiente. La necesidad de este análisis se justifica en la falta de políticas coherentes en este ámbito y la existencia de gran número de gravámenes, sin coherencia ni consistencia, que pueden vulnerar los principios constitucionales y poner en peligro los compromisos adquiridos en materia medioambiental y energética.
This work critically analyzes the taxation of electricity self-consumption from renewable sources in Spain, examining the tax figures dealing with this reality and proposing measures that respond more efficiently to the purpose of protecting the environment. The need for this analysis is justified by the lack of coherent policies in this area and the existence of a large number of taxes, without coherence or consistency, which may violate constitutional principles and jeopardize the commitments acquired in environmental and energy matters.
