El presente trabajo ensaya la utilidad metateórica de la distinción filosófica entre “dintorno”, “entorno” y “contorno” para reordenar críticamente las dife-rentes posiciones teóricas en torno al problema de la determinación de los límites del Derecho —el problema de la autonomía o la demarcación de la categoría jurídica— y particularmente para clarificar los términos y las implicaciones del debate entre concepciones positivistas y post-positivistas. Se sostiene que la mencionada distinción permite captar la significación de los elementos constructivos, dinámicos y prácticos de la noción de “límite” de mejor manera que la concepción iuspositivista, asociada a una visión negativa o segregativa de los límites del Derecho.
This paper seeks to test the meta-theoretical relevance of a philosophical distinction coined by certain Spanish thinkers—the distinction between “dintorno”, “entorno” and “contorno”—in critically reordering the different theoretical positions around the problem of determining the limits of law (the problem of law’s autonomy or demarcation) and particularly in clarifying the terms and implications of the debate between positivist and post-positivist conceptions. It is argued that the aforementioned distinction allows us to better grasp the constructive, dynamic and practical elements of the notion of “limit” than legal positivism’s conception and its negative or segregative vision of the limits of the Law.
