Resumen de El nudo roto entre Derecho, mercado y política. Un marco psicoanalítico

  Este artículo ofrece una aproximación psicoanalítica al Derecho en el contex-to de un mercado global como el actual. El propósito es explicar la ruptura entre Derecho, mercado y política, como consecuencia de la globalización económica, y proponer un esquema para pensar su posible articulación. Para explicar esa ruptura se describen tres modos de relación con el Derecho en la evolución de la economía de mercado, en analogía con los modos de relación con la ley edípica en las tres estructuras psíquicas que define Lacan (psicótica, neurótica, perversa); la conclusión es que el modo de relación con el Derecho en el contexto económico actual corresponde a una estructura perversa. Para pensar la posible articulación entre Derecho, mercado y política, se recurre a una analogía entre esos tres campos de relación social con los tres registros de lo psíquico según Lacan —simbólico, imaginario, y real—, y al concepto de sinthome, como solución singular que permite anudar los tres registros.   The article offers a psychoanalytic approach to law in the context of the current global market. It aims to explain the decoupling between the law, markets, and politics as a consequence of economic globalization and suggests a framework to rethink how they ought to relate to each other. In order to explain their present rift, it describes how the evolution of the market economy has resulted in three modes of relationship vis-à-vis the law, in analogy with the modes of relationship to Oedipal law operative in the three psychic structures defined by Lacan (psychotic, neurotic, perverse), and argues that the prevailing mode in the current economic context reflects a perverse structure. In order to envision a potential link connecting the law, markets, and politics, a further analogy is drawn between these three fields of social activity and the three registers of mental functioning established by Lacan –symbolic, imaginary, and real–, as well as with the Lacanian concept of sinthome as a unique solution that allows these three registers to be knotted together. Summaries of select concepts of psychoanalytic theory conducive to a fuller understanding are included in the text.
