Los elementos de contraste entre la contingencia norteamericana de incapacidad permanente contributiva y su equivalente española se refieren a muy diversos aspectos. Entre ellos, el autor destaca en sus conclusiones tres. En primer lugar, frente a los cinco grados de la contingencia española y su impacto sobre la litigiosidad que soportan nuestros tribunales laborales, el hecho de que en el Derecho norteamericano sólo exista un único grado, relativamente coincidente con la llamada en España incapacidad permanente total cualificada. En segundo lugar, frente a la brevedad (y tan frecuentemente, la inutilidad) de la reclamación administrativa previa española de seguridad social, el hecho de que en los Estados Unidos esa vía sea a la vez larga e inquisitoria, también en materia de incapacidad permanente contributiva, lo que contribuye a filtrar eficazmente los asuntos susceptibles de ser luego impugnados ante los tribunales. En tercer lugar, la revalorización automática de las pensiones norteamericanas de incapacidad permanente contributiva con arreglo al coste de la vida (al igual que sucede en los Estados Unidos, también con las pensiones de jubilación), un asunto muy controvertido, pero que también está muy necesitado de debate profundo y sereno en España.
The contrasting elements between the American contingency of permanent work-related disability and its Spanish equivalent refer to very different aspects. Among them, the author highlights three in his conclusions. First, compared to the five degrees of the Spanish contingency and their impact on the litigation endured by our labour courts, in US law there is only one degree, relatively coinciding with the total qualified permanent disability in Spain. Second, in view of the brevity (and so often the futility) of the Spanish prior administrative social security claim, in the United States this route is long and inquisitive, also in terms of permanent work-related disability, which helps to effectively filter out cases that may later be challenged in court. Third, the automatic revaluation of US pensions for permanent work-related disability based on the cost of living (as is also the case in the United States with retirement pensions), is highly controversial issue, but one that is in dire need of a calm and in-depth debate in Spain.
