La pandemia ocasionada por la Covid19 ha propiciado la utilización masiva del teletrabajo en aquellos sectores de la actividad económica en que se hace posible como medio fundamental de preservar los contagios que pudieran ser producidos por el coronavirus y que, precisamente con el distanciamiento social que esta forma de actividad propicia, trata de evitarse.No obstante, no podemos ocultar que debido a la aparición repentina de la epidemia y su facilidad pasmosa de propagación, la realidad del teletrabajo, hasta entonces minoritaria y especialmente en España, se ha impuesto de forma abrupta, con urgencia y sin el debido asentamiento y maduración que este tipo de procesos disruptivos requieren.En el presente artículo queremos abordar de forma amplia esta modalidad de desempeño laboral haciendo referencia a sus orígenes, su justificación y razón de ser, las indudables ventajas pero también inconvenientes que presenta, su regulación legal, haremos también mención al teletrabajo en la Administración Pública y finalizaremos con unas conclusiones sobre todo lo mencionado.Para la realización de este trabajo nos hemos servido de estudios realizados por diversos autores especializados, de artículos y noticias de naturaleza periodística recientemente aparecidos, del análisis de la normativa reguladora al respecto y de la propia experiencia profesional como funcionario de la Administración de la Seguridad Social.
The pandemic caused by COVID-19 has led to the widespread use of remote working in those sectors in which it is possible to implement as a fundamental way to avoid the contraction of the coronavirus and to allow for social distancing.However, we cannot hide the fact that due to the sudden onset of the epidemic and its staggering ease of spread, the reality of remote working, which was hitherto unusual, especially in Spain, has been imposed suddenly, urgently and without the due establishment and maturation that this type of disruptive process requires.In this article, we want to broadly address this type of work performance, referring to its origins, its justification and rationale, the undoubted advantages and the disadvantages it presents, and its legal regulation. We will also mention remote working in public administration and we will end with some conclusions on all the aforementioned.To carry out this work, we have made use of studies carried out by various specialised authors, recently published articles and news items of a journalistic nature, the analysis of the relevant regulations and our own professional experience as civil servants in the Social Security Administration.
