    La existencia de instrumentos europeos de reconocimiento mutuo de resoluciones penales, entre los que se encuentra la Orden Europea de Protección y el Certificado civil, hace plantearnos si la extranjera víctima de violencia de género y sus hijos e hijas tienen limitaciones para efectuar la movilidad intraeuropea entre los distintos Estados miembros. Para garantizar la aplicación coherente de la legislación de la UE vincularemos diversas normativas en materia civil, penal y de Derecho internacional privado, como el texto de Refundición de Reglamento de Bruselas II bis, que afectan a las extranjeras y a su prole en escenarios de violencia de género.Asimismo, según el compromiso de la UE relativo al refuerzo de los derechos y de la protección de las víctimas de violencia de género y de sus hijos e hijas, pondremos de relieve la necesidad de emprender una iniciativa que se vea concretada en una normativa europea sobre un estatuto armonizado de residencia legal para dichas extranjeras, que a su vez facilite el acceso seguro a una movilidad intra-europea

    The existing European instruments regarding the mutual recognition of the EU penal rulings, such as the European Protection Order and the civil certificate; make us consider if the foreign victim of gender / domestic violence and her children have limitations to undertake intra-European mobility between the different Member States.To ensure the consistent application of the EU legislation, we will link the diverse civil, penal and private international regulations, namely the Recast text of the Bruselas II bis Regulation, which affect the foreigner and her children in Gender Based Violence or Domestic violence situations.Therefore, on the grounds of the EU commitment to strengthening the rights and the protection of the victims and their children, we will highlight the need to undertake an initiative to be concretized in a European regulation regarding a harmonized statute of legal residence for these foreigners, which in turn facilitates safe access to intra-European mobility
