Han pasado más de treinta cinco años desde que el legislador reformara el sistema de incapacitación y las instituciones de guarda y protección con la Ley 23/1983, de 24 de octubre. No solo el excesivo tiempo transcurrido desde entonces, sino la irrupción de hitos como la ratificación por España de la Convención de los derechos de las personas con discapacidad en 2008, refieren un nuevo estado de cosas que obligan a adaptar el tratamiento jurídico de las personas con discapacidad a los principios de dicho texto internacional y a la diversidad que lleva ínsita. Hasta ese momento que parece estar más cerca, abundamos en la meritoria labor de adaptación realizada por la jurisprudencia del Tribunal Supremo. No obstante, mención especial y sobresaliente por cuanto conforma un material valioso para nuestro estudio, exige el Proyecto de Ley por la que se reforma el legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica de 17 de julio de 2020 actualmente objeto de tramitación parlamentaria que, si bien avanza hacia una profunda reforma legislativa, adolece de algunos defectos sobre los que hemos reflexionado. En segundo lugar, situados en el ámbito doctrinal, debe ponerse en valor la Propuesta de Código Civil de la Asociación de Profesores de Derecho Civil de 2018, en particular, del Título VII del Libro I que, junto con un buen número de aportaciones doctrinales sobre esta materia, nos servirán de guía en nuestro estudio y a buen seguro serán atendidas por el legislador en la actual tramitación parlamentaria.
More than thirty-five years have passed since the legislature reformed the incapacitation system and the institutions of guard and protection with Law 23/1983 of 24 October. Not only the excessive time since then, but the emergence of milestones such as Spain's ratification of the Convention on the Rights of Persons with Disabilities in 2008, refer to a new state of affairs that require adapting the legal treatment of persons with disabilities to the principles of that international text and to the diversity it brings. Until that moment that seems to be closer, we abound in the meritorial adaptation work carried out by the jurisprudence of the Supreme Court. However, a special and outstanding mention as it forms a valuable material for our study requires the Draft Law reforming civil and procedural legislation to support persons with disabilities in the exercise of their legal capacity of 17 July 2020 currently under parliamentary processing which, while moving towards profound legislative reform, suffers from some flaws on which we have reflected. Secondly, located in the doctrinal field, the Proposal for a Civil Code of the Association of Civil Law Teachers 2018, in particular Title VII of Book I, which, together with a number of doctrinal inputs on this subject, will guide us in our study and will surely be attended by the legislator in the current parliamentary process, must be valued.
