Desde o final de dezembro de 2019, tem se ouvido muito falar acerca de uma doença infecciosa do trato respiratório causada pelo coronavírus (Covid-19). Para além da dificuldade dos profissionais de saúde no manejo direto com os pacientes infectados ou que apresentam sintomas suspeitos, os instrumentos jurídicos têm sido de suma importância na tentativa de conter o avanço da doença. Neste contexto, o presente trabalho discorre sobre a possibilidade de restrição das liberdades individuais, primeiramente, sob uma ótica Constitucional e, em um segundo momento, sob a ótica do Direito Penal, a partir da análise dos esforços engendrados pelo Estado brasileiro. Para tanto, a pesquisa se valerá de conceitos elaborados pela doutrina especializada e de instrumentos jurídicos a nível federal, bem como empregará o método hipotético-dedutivo de abordagem, partindo da hipótese de que em determinadas situações o interesse público poderá se sobrepor aos interesses individuais.
Since the end of December 2019, we have heard a lot about an infectious disease of the respiratory tract caused by the coronavirus (Covid-19). In addition to the difficulty of health professionals in direct management with infected patients or those with suspicious symptoms, legal instruments have been of paramount importance in trying to contain the progress of the disease. Along this path, the present work analyzes the possibility of restricting individual freedoms, firstly from a Constitutional point of view and then from the perspective of Criminal Law, based on the efforts engendered by the Brazilian Government. Therefore, the research will use concepts developed by specialized doctrine and legal instruments at federal level, as well as using the hypothetical-deductive approach, based on the hypothesis that in certain situations the public interest may override individual interests.
