A través del presente artículo se pretende analizar, partiendo de un examen de aquellas singularidades que afectan a la exención de la obligación de declarar que el legislador concede a las víctimas de un hecho delictivo cuando su presunto autor se encuentra relacionado con ellas por vínculos de parentesco, matrimoniales o análogos, el cambio introducido por el Tribunal Supremo, con el pronunciamiento de la sentencia n.o 389/2020, de 10 de julio, en la interpretación de la incidencia que el ejercicio por aquellas de la acusación particular provoca en la ulterior posibilidad de acogerse a esa exención o dispensa. El criterio finalmente adoptado por el Pleno de la Sala Segunda convierte dichas facultades procesales en absolutamente antagónicas proclamando así la irrecuperabilidad del derecho de dispensa cuando previamente, quien fue víctima del hecho investigado promovió el ejercicio de la acción penal y/o civil contra el acusado, aún cuando en un momento posterior y antes de su concurrencia al llamamiento judicial, hubiere cesado en él.
The present article seeks to analyze, based on an examination of the special features that affect the exemption from the obligation to declare that the legislator grants to the victims of a criminal act when the alleged perpetrator is related to them by family, marriage or similar ties, the change introduced by the Supreme Court, with the pronouncement of Ruling No. 389/2020 of July 10, in the interpretation of the impact that the exercise by those of the private prosecution causes in the subsequent possibility of benefiting from that exemption or dispensation. The criterion finally adopted by the Plenary of the Second Chamber makes those procedural powers absolutely antagonistic, thus proclaiming the irrecoverability of the right to dispensation when previously, the person who was the victim of the act under investigation promoted the exercise of the criminal and/or civil action against the defendant, even if at a later moment and before his attendance to the judicial appeal, he had ceased to exercise it.
