La llegada de las nuevas tecnologías han impactado notablemente en las sociedades actuales en las que vivimos. Ningún ámbito de nuestra vida es ajeno a este fenómeno, ni mucho menos lo es el de las relaciones laborales. El uso de las mismas por parte de los trabajadores y el control que pueden efectuar los empresarios con motivo de las potestades que les otorga el ordenamiento jurídico nacional, hace que la intromisión o injerencia de estas tecnologías en las relaciones empleador-empleado se presente tanto en una vertiente positiva como en una negativa. La positiva haría referencia al uso de las mismas para mejorar la eficacia y las condiciones de la productividad. La negativa tiene que ver con la posibilidad de vulneración de los derechos laborales y fundamentales de los trabajadores en el uso del empleador de estos mecanismos. Por ello, este trabajo centrará su atención en mostrar cuál ha sido el impacto de estas tecnologías y cómo se ha afrontado por parte de la doctrina científica, la jurisdiccional y el legislador en el ámbito de la videovigilancia empresarial. Se intentará mostrar el impacto en el centro de trabajo de este concreto medio tecnológico para luego dar paso a resoluciones judiciales nacionales e internacionales concretas sobre el asunto y la normativa comunitaria y nacional al respecto vigente a día de hoy.
The advent of new technologies has had a major impact on today’s societies in which we live. No area of our life is alien to this phenomenon, much less that of industrial relations. The use of new technologies by workers and the control through them that employers can carry out in connection with the powers conferred on them by the national legal order, causes the interference or interference of these technologies in the employer-employee relations to occur in both a positive and a negative direction. The positive would refer to the use of them to improve efficiency and productivity conditions. The refusal has to do with the possibility of infringement of workers; fundamental and labour rights. For this reason, this work will focus on showing what the impact of these technologies has been and how they have been addressed by scientific doctrine, the judiciary and the legislator in the field of corporate video surveillance. An attempt will be made to show the impact on the workplace of this specific technological medium and then to give way to specific national and international judicial decisions on the matter and the Community and national legislation on the subject in force today.
