El trabajo aborda la problemática del bien común, enmarcado en el ámbito de la Teoría del Estado y en el Derecho Constitucional Argentino. En el primer aspecto, incursiona en la posición que analiza al Estado a partir de las causas del mismo y no su estructuración sobre la base de los elementos. No obstante, advierte que, también quienes estudian al fenómeno estatal sobre la base de los elementos constitutivos y que se adhieren a una postura deontológica, reconocen que el Estado posee fines. En el segundo aspecto, se indaga sobre la recepción del bien común en la Constitución Nacional posibilitando incursionar en su “techo ideológico” con su implicancia en las funciones que se le atribuyan al Estado. Asimismo analiza el mandato constitucional de “proveer lo conducente al desarrollo humano, al crecimiento con justicia social” y su relacionamiento con el bienestar general del Preámbulo.
Die Arbeit erläutert die Problematik des Gemeinwohls im Rahmen der Staatstheorie und des argentinischen Verfassungsrechts. Ein erster Aspekt geht auf jene Position ein, die den Staat ausgehend von seinen eigentlichen Ursachen analysiert und nicht in Hinblick auf seine auf Elementen basierende Strukturierung. Es wird dabei jedoch darauf hingewiesen, dass auch diejenigen, die das Phänomen des Staates unter dem Gesichtspunkt der ihn verfassenden Elemente untersuchen und sich einer deontologischen Position anschließen, anerkennen, dass der Staat Zwecke besitzt. Ein zweiter Aspekt bezieht sich auf die Rezeption des Gemeinwohls in der Nationalen Verfassung Argentiniens und erlaubt es, auf sein „ideologisches Dach“ einzugehen und auf die hier implizierten, dem Staat zugeschriebenen Funktionen. Gleichzeitig wird das Verfassungsmandat analysiert, „alles der menschlichen Entwicklung, dem Wachstum der sozialen Gerechtigkeit Dienliche“ zu fördern, sowie seine Beziehung zur in der Präambel ausgedrückten Idee der allgemeinen Wohlfahrt.
This article deals with the issue of common good within the theory of State and the Argentine Constitutional Law. The first aspect refers to the position of analysing the state from its own causes, rather than from its structure upon the basis of elements. Nevertheless, it adverts to the fact that, those who study the state phenomenon upon the basis of constituent elements and adhere to a deontological position, recognize that the State has its own aims. The second aspect deals with the reception of common good in the National Constitution and provides a way to its “ideological limit” with implications of the functions attributed to the state. Moreover, it analyses the constitutional mandate “to provide for human development, the growth of social justice” and its relationship to the general welfare of the Preamble.
