La evolución en la relevancia política de las relaciones internacionales en un mundo cada vez más interconectado ha conllevado el auge de convenios y tratados de derecho internacional y de derechos humanos. En ese sentido, la legislación internacional, que tiene como sujeto a los niños, incluye el derecho a la educación. La legislación chilena ha recibido e integrado estas normas internacionales en su ordenamiento normativo, quedando pendiente alguna posibilidad concreta de exigir su cumplimiento. Vinculado al problema del trabajo infantil (y de la salud), la educación es un sector inequívoco para el empoderamiento de los individuos y el aumento de la equidad en la sociedad, característica indispensable para el desarrollo sustancial y general de los Estados. Chile es un ejemplo formidable porque demuestra que los avances formales y un desenvolvimiento económico favorable no contienen un automatismo para superar los problemas de fondo.
Die Entwicklung der politischen Bedeutung der internationalen Beziehungen in einer immer stärker miteinander verbundenen Welt hat zu einem Anstieg von Abkommen und Verträgen zu Menschenrechten und internationalem Recht geführt. Die internationale Gesetzgebung, die Kinder zum Gegenstand hat, schliesst das Recht auf Erziehung mit ein. Die chilenische Gesetzgebung hat diese internationalen Normen aufgenommen und in ihre Rechtsordnung integriert, konkrete Möglichkeiten ihrer Umsetzung stehen aber noch offen. Im Zusammenhang mit dem Problem der Kinderarbeit (und -gesundheit) ist die Erziehung unzweifelbar ein Bereich des Empowerment der Individuen und der Steigerung der sozialen Gerechtigkeit, eines der unabdingbaren Merkmale einer anhaltenden, allgemeinen Entwicklung der Staaten. Chile ist ein gutes Beispiel für diese Problematik, denn hier zeigt sich, dass die formalen Vorschritte und eine günstige wirtschaftliche Entwicklung keinen Automatismus für die Lösung der grundlegenden Probleme enthalten.
The evolution of the political relevance of international relations in an interconnected world has increased the number of agreements and treaties of international right and human rights. In that sense, international legislation which deals with children as subjects includes the right to education. The Chilean legislation has received and integrated these international rules in its normative ordering, though some concrete possibilities to demand their fulfillment are still pending. Related to the problem of child work (and health), education is an unequivocal sector for the empowering of individuals and the increase of equality in society, an indispensable characteristic for the substantial and general development of States. The demand for the implementation of the institutional and substantial measures subscribed in the international or legislated in the national realm is one of the formal aspects which have to be developed. Chile is a good example because it demonstrates that formal advances and a favorable economic development do not automatically guarantee the improvement of fundamental problems.
