Nell'ambito del problema della natura civilistica oppure onoraria dei'iudicia bonae fidei', il saggio analizza la controversa categoria degli 'arbitria honoraria' di cui si legge in Cic. pro Roscio com. 5.15. Attraverso una lettura attenta delle formule contenute in Cic, de off. 3.17.70 ed in altri luoghi ciceroniani sembra possibile sostenere la rilevanza delle formule con clausola 'quod aequius melius', che portarono ad un ampliamento, anche attraverso la recezione ad opera del pretore, delle prassi inaugurate dai rapporti tra 'cives' e stranieri in ordine alle forme di tutela riconosciute tra il IV ed il III secolo a.C.
In the context of the question of the civilistic or honorary nature of the 'iudicia bonae fidei', the essay analyzes the controversial category of 'arbitria honoraria' mentioned in Cic. pro Roscio com, 5.15. Through a careful reading of the 'formulae' contained in Cic. de off. 3.17.70 and in other Ciceronian escapes it seems possible to support the relevance of the formulas with the clause 'quod aequius melius', which lead to a widening, also through the reception by the praetor of practices inaugurated by relations between 'cives' and foreigners forms of protection recognized between the 4rd and 3nd centuries.
