Este trabajo aborda algunas cuestiones controvertidas que plantea la práctica administrativa aplicativa del supuesto especial de responsabilidad solidaria que contempla el artículo 42.2 a) de la Ley General Tributaria. Esta norma regula la responsabilidad solidaria de los que sean causantes o colaboren en la ocultación o transmisión de bienes y derechos que impidan la actuación de la Administración. El autor sostiene la tesis de que este precepto legal se refiere exclusivamente a la distracción de bienes que impiden la acción ejecutiva de la Administración tributaria, y acota su ámbito natural al procedimiento de recaudación ejecutiva. También reflexiona sobre la prescripción y la nula interferencia del proceso concursal en su consumación.
This work addresses some controversial issues raised by the administrative application practice of the special assumption of joint and several liability contemplated in article 42.2 a) of the General Tax Law. This norm regulates the joint and several liability of those who cause or collaborate in the concealment or transmission of goods and rights that prevent the Administration from acting. The author maintains the thesis that this legal provision refers exclusively to the distraction of assets that impede the executive action of the Tax Authority, and limits its natural scope to the procedure of executive collection. It also reflects on the statute of limitation and the null interference of the bankruptcy process in its consummation.
