The constitutional debate sparked by the fight against the covid pandemic has raised old fears about the supposed absence of well- defined legal limits between the state of constitutional exception and constitutional normality.
in the portuguese legal-constitutional system, the fight against the pandemic does not justify a state of permanent material exception – the exception to the state of exception – that would legitimize ad hocrules for the allocation of executive power and measures to compress the menu of fundamental rights subjected to the tyranny of the exclusive purpose of protecting health, allegedly outside of the constitutionality weighting regime. the Portuguese constitution proclaims negative intangible limits to the state of exception, such as the separation of powers and one concrete constitutional division of powers. the constitutional principle of reservation of a restricted parliamentary law, that protects a qualified material domain that demands regulation by legislative act, and the subjection to proportionality tests are constitutional requirements that must survive epidemic crises and health emergencies, in constitutional post- exception normality.
