La respuesta del Estado a la pandemia provocada por el Covid19 se ha realizado mediante la declaración del estado de alarma. El autor considera que acudir al estado de alarma ha situado la política en clave de ordeno y mando –militar– cuando debían de haber sido la transparencia y auto responsabilidad de la ciudadanía los principios rectores. La normativa sanitaria es suficiente para responder a la pandemia, quedando exclusivamente algunos aspectos relativos a la movilidad interterritorial necesitados de una normativa estatal, que únicamente con ese objeto podría ser cubierta por la declaración del estado de alarma. Las comunidades autónomas (CCAA) son las competentes en materia de sanidad, educativas, actividad comercial, así como de orden público, en especial las que tienen policías propias. Por este motivo las Autoridades Competentes delegadas debían haber sido autonómicas y no estatales. La actuación conjunta debía haberse desarrollado mediante instrumentos de coordinación y no asumiendo el Estado directamente las competencias. La respuesta autonómica y/o local ante la situación hubiese sido la adecuada por su flexibilidad y adecuación a las circunstancias. La desescalada así lo ha puesto de manifiesto. El Estado ha actuado como si los Gobiernos autonómicos no existieran, fundamentalmente en el comienzo de la pandemia.
The State's response to the pandemic caused by Covid19 has been carried out by declaring the state of alarm. The author considers that going to the state of alarm has placed politics in the key of command –military– when transparency and self-responsibility of citizens should have been the guiding principles. Health regulations are sufficient to respond to the pandemic, and aspects related to interterritorial mobility in need of state regulations, which could only be covered by the declaration of the state of alarm for that purpose. The CCAA are competent in matters of health, education, commercial activity, as well as public order, especially those that have their own police. For this reason, the competent authorities delegated should have been autonomous and not state. The joint action should have been developed through instruments of coordination and not by directly assuming the powers. The regional and / or local response to the situation would have been adequate due to its flexibility and adaptation to the circumstances. The de-escalation has shown this. The State has acted as if the regional governments did not exist, mainly at the beginning of the pandemic.
