El presente artículo expone la configuración y el funcionamiento de las reglas relativas a la carga de la prueba en procedimientos en materia de derecho de la competencia de la Unión Europea. La obra muestra cómo la interrelación existente entre estas reglas y el estándar de prueba determina en última instancia el desplazamiento de la carga de la prueba y hace recaer sobre una de las partes las consecuencias negativas de no sustanciar suficientemente una alegación o una defensa. Todo ello se ve influenciado en los últimos años por la generalización de la prueba por presunciones y la figura de las restricciones por objeto, que, siendo válidas, deben en todo caso se aplicadas restrictivamente. En este sentido, el artí-culo aborda la reciente configuración jurisprudencial de esta figura a la luz de las sentencias en los asuntos Cartes Bancaires, GlaxoSmithKline e Intel.
This article outlines the framework and the functioning of the rules regarding the burden of proof in EU Competition Law proceedings. The paper shows how the interplay between these rules and the standard of proof ultimate-ly determines the shift of the burden of proof, placing on one of the parties the negative consequences of an insufficiently substantiated claim or defense. All this has been influenced in recent years by the increased use of presumptions and by object restrictions, which, being valid, must in any case be applied restrictively. In this respect, the article addresses the approach of the CJEU in recent case-law, in particular, in the Cartes Bancaires, GlaxoSmithKline and Intel cases.
