El presente trabajo parte de dos premisas que se desarrollan a lo largo del mismo. La primera parte de la idea de que toda sociedad es una trama o tejido de textos entre los que el jurídico ocupa un papel destacado y, a su vez dentro del él el trabajo se detiene en el discurso de los derechos humanos cuyo protagonismo y centralidad se analiza a la luz de los cambios que la globalización del derecho trae consigo. La segunda parte de la consideración de que cada vez más nuestra sociedad tiende a identificarse con el mercado. El mercado quiere y requiere herramientas jurídicas ligeras y flexibles capaces de adaptarse a sus necesidades. El mercado tiende a limitar o anular cuantos obstáculos frenen o dificulten su lógica natural de producción de riqueza. En ese contexto ha de analizarse si los derechos humanos son percibidos como cargas u obstáculos y, en su caso, cuál es el horizonte y futuro próximo de los mismos.
This work is based on two premises that are developed throughout it. The first part of the idea that every society is a plot or fabric of texts among which the legal plays a prominent role and, in turn, within it the work stops in the discourse of human rights whose protagonism and centrality analyzes in light of the changes that the globalization of law brings with it. The second part of the consideration that more and more our society tends to identify with the market. The market wants and requires light and flexible legal tools capable of adapting to their needs. The market tends to limit or cancel all obstacles that slow or hinder its natural logic of wealth production. In this context, it must be analyzed if human rights are perceived as burdens or obstacles and, where appropriate, what are their horizon and future.
