Resumen de Do contrato liberal ao contrato existencial: a mudança de paradigmas na hermenêutica contratual

  This text aims to demonstrate the possibility of a contractual distinction that can guarantee a better protection of human life, moving away from this legal institute from the mere analysis of classical patrimonialism and approaching it in the light of the fundamental norms that illuminates the entire contemporary legal system, through consideration of the contract as “existential”. In order to do so, the analysis of paradigmatic changes in contractual hermeneutics was made, from the liberal paradigm to finally, from the perspective of the expansive effectiveness of fundamental rights, to present the foundations that support the existential contract.

  O presente trabalho visa demonstrar a possibilidade de uma distinção contratual que consiga garantir melhor tutela à vida humana, afastando esse instituto jurídico da mera análise patrimonialista clássica e aproximando-o da luz das normas fundamentais que ilumina todo o sistema jurídico contemporâneo, por meio da consideração do contrato como “existencial”. Para tanto, foi feita a análise das mudanças paradigmáticas na hermenêutica contratual, passando inicialmente do paradigma liberal para, finalmente, sob a ótica da eficácia expansiva dos direitos fundamentais, apresentar os fundamentos que apoiam o contrato existencial.
