Desde la entrada en vigor del Real Decreto-ley 8/2019, de 8 de marzo, de medidas urgentes de protección social y de lucha contra la precariedad laboral en la jornada de trabajo las empresas tienen la obligación de garantizar el registro diario de la jornada. El objetivo perseguido con el establecimiento de esta obligación es la lucha contra el fraude en las horas extraordinarias, posibilitando el control por parte de la Administración de las horas efectivamente trabajadas para comprobar que se respetan los límites legales y convencionales y que se retribuyen todas las horas extraordinarias realizadas. La medida ha sido cuestionada por los empresarios y aplaudida por los sindicatos, y todavía es pronto para saber si realmente está cumpliendo su objetivo. Lo que sí se puede observar es también ha tenido el efecto de poner luz sobre determinados incumplimientos contractuales por parte del trabajador, que han dado lugar a despidos. Las cuestiones surgidas en este sentido y el criterio seguido en las resoluciones judiciales emitidas en estos primeros meses de aplicación de la norma son el objeto del presente trabajo
Since the entry into force of the Royal Decree-Law 8/2019, the 8th of March, of urgent social protection measures and measures to combat precarious working conditions during working hours, companies have been required to ensure the daily registration of working hours. The aim of this obligation is to combat overtime fraud, allowing the administration to monitor the hours actually worked to verify that the legal and conventional limits are respected and that all overtime worked is remunerated. The measure has been questioned by employers and applauded by trade unions, but it is still too early to say whether it is actually achieving its objective. What can be observed is that it has also had the effect of shedding light on certain contractual breaches on the part of the worker, which have resulted in dismissals. The issues raised in this respect and the approach followed in the court resolutions in these first months of application of the rule are the subject of the present work
