Requiriéndose declaración judicial para que opere la nulidad, y en el entendido de que un vicio de invalidez es presupuesto y causal de nulidad, este trabajo analiza críticamente la configuración dada en el derecho chileno en virtud de la que contratos ilegales en grado de invalidez, incluso habiéndose constatado la ilegalidad mediante sentencia judicial ejecutoriada, siguen teniéndose por eficaces sin que exista norma jurídica alguna que autorice la eficacia de tales negocios jurídicos viciados, en virtud de los que, faltando una declaración de nulidad, se tiene a la Administración del Estado por obligada en contratos que al no encontrarse válidamente celebrados, no pueden conferir fuerza obligatoria. Por otra parte, se proponen soluciones a la problemática planteada, las que pasan tanto por las alternativas que ofrecen las acciones ordinarias de nulidad (en el ámbito administrativo y civil), como la acción especial de impugnación creada por la Ley N° 19.886.
Given a court resolution is required to apply nullity, and on the basis that invalidity is the preliminary finding and cause for nullity, this work analyses, from a critique standpoint, the setting existing in Chilean law by virtue of which illegal contracts that are no longer in force, even when the illegality has been ascertained by way of legal executed judgment, are still regarded as efficient without any legal norm that authorises the efficacy of said defective legal businesses, by virtue of which, lacking a declaration of invalidity, the State Administration is bound by contracts that as they have not been validly entered into, they cannot give binding force. On the other hand, solutions comprising alternatives that both offer the ordinary invalidity actions (within the administrative and civil scope), as well as the special actions to challenge created under Act No. 19.886 are proposed.
