La medicina genética o genómica es una realidad, su integración en nuestra sociedad y en los sistemas de salud es imparable. Las posibilidades que ofrece esta tecnología para el diagnóstico y el tratamiento de enfermedades son inauditas e incalculables. No obstante, el desarrollo de esta técnica supone también hacer frente a importantes cuestiones, algunas de ellas apremiantes para el Derecho. Al respecto en este trabajo se tratará la protección, almacenamiento y tratamiento de los datos genéticos, especialmente a través de los biobancos; así como la implicación de la medicina genética en los derechos del paciente (derecho al consejo genético y a las pruebas predictivas, y el derecho a la medicina personalizada).
Genetic or genomic medicine is a reality, its integration into our society and health systems is unstoppable. The possibilities offered by this technology for the diagnosis and treatment of diseases are unprecedented and incalculable. However, the development of this technique also involves addressing important issues, some of them pressing for the Law. In this regard, the protection, storage and treatment of genetic data will be discussed, especially through biobanks; as well as the involvement of genetic medicine in the rights of the patient (right to genetic counseling and predictive tests, and the right to personalized medicine).
