La tasación pericial contradictoria, en todo caso, tiene su origen en una comprobación de valores de la Administración tributaria, en la que necesariamente debe existir una valoración de un perito propuesto por la Administración como por el obligado tributario, y que podrá precisar la intervención de un perito tercero, cuya valoración entonces será dirimente y servirá, por tanto, de base a la liquidación que proceda con los límites del valor declarado y el valor comprobado inicialmente por la Administración tributaria.
La tasación pericial contradictoria, cabría afirmar, está encaminada siempre a dilucidar qué valoración (la que resulte de la tasación del perito de la Administración, la del obligado tributario o la del perito tercero) servirá de base a la liquidación tributaria que cierra el procedimiento e impide una nueva comprobación de valor por la Administración tributaria sobre los mismos bienes o derechos.
The contradictory expert appraisal, in any case, has its origin in a verification of values by the Tax Administration, in which there must necessarily be an appraisal by an expert proposed by the Administration as well as by the taxpayer, and which may require the intervention of a third party expert, whose appraisal will then be decisive and will therefore serve as the basis for the appropriate settlement with the limits of the declared value and the value initially verified by the Tax Administration.
The contradictory expert appraisal, it could be said, is always aimed at determining which valuation (that resulting from the appraisal of the Administration's expert, that of the taxpayer or that of the third party expert) will serve as the basis for the tax assessment that closes the procedure and prevents a new verification of value by the Tax Administration on the same assets or rights.
