Coincidiendo con el final de la reforma del mecanismo de garantía del Convenio Europeo de Derechos Humanos (2000-2019), la idea del artículo es analizar el alcance de esta reforma con el fin de evaluar su impacto sobre el sistema considerado en su conjunto y valorar su eficacia de cara a su pervivencia a largo plazo. Las conclusiones obtenidas al respecto se basan en un estudio de la reforma misma (configurada como un largo “proceso” que ha girado en torno a dos ejes principales: el derecho de recurso individual y el principio de subsidiariedad), y de las diferentes medidas adoptadas, tanto a nivel europeo como a nivel nacional, de las que se ofrece una panorámica general.
Coinciding with the end of the reform of the European Convention on Human Rights control system (2000-2019), the following paper aims to analyse the scope of the reform, to evaluate its impact on the the system as a whole and to assess its effectiveness in the long term system viability. The findings reached are based on the study of the reform itself (configured as a long process which has revolved around two main axes: the right of individual petition and the principle of subsidiarity) and on the general review of the different measures taken, both at European and at national level.
