La Corte Interamericana De Derechos Humanos ha desarrollado una amplia jurisprudencia en materia de combate a la impunidad y acceso a la justicia, sobre todo en casos que involucran la creación y aplicación de leyes de amnistía. Sin embargo, dichos desarrollos han generado tensiones –al menos en la teoría– con procesos de justicia transicional en curso en América. El presente trabajo identifica dichas tensiones y propone un cambio de enfoque de la aproximación de la Corte hacia las leyes de amnistía en contextos de justicia transicional: desde una aproximación uniforme hacia un acercamiento casuístico.
The Inter American Court of Human Rights has developed a vast case-law regarding the fight against impunity and access to justice, especially in cases pertaining the creation and application of amnesty laws. However, those developments have led to tensions within transitional justice mechanisms –at least in theory– that are underway in America. The present work identifies such tensions, and proposes a change of perspective regarding the Court’s approximation towards amnesty laws within transitional justice contexts: from a uniform application towards a tailor made approach.
