El propósito del trabajo es demostrar, a través de una relectura constitucional, el alcance de la autonomía privada post mortem y superar el prejuicio de que el único acto por causa de muerte admisible en nuestro sistema legal es el testamento. Desde este punto de vista, primerose aclara que los actos de última voluntad se oponen a los actos entre los vivos y no a los actos por causa de muerte, y, posteriormente, se propone superar la teoría que distingue entre el contenido típico y atípico del testamento.
Además, se demuestra que nuestro sistema legal conoce actos de última voluntad diferentes del testamento, y se llega a afirmar que, más allá de las hipótesis expresamente reguladas, la persona puede confiar a un acto de última voluntad diferente del testamento cualquier interés post mortem que no afecta a la delación. Por lo tanto, se trata de afirmar que la prohibición de los pactos sucesorios se refiere solo a los actos de disposición de la delación y que los actos de última voluntad pueden regular todos los intereses distintos de los que afectan a la delación.
The purpose of rhe work is to demonstrate, through a constitutional rereading, the extent of private autonomy post mortem and to overcome the prejudice rhat the only act mortis causa admissible in our legal system is rhe will. From this point of view, first ir is clarified that acts inter vivos are opposed to acts of last will and not to acts mortis causa and, subsequently, it aims to overcome rhe theory that distinguishes berween typical and arypical content of the will. Moreover, ir is proved that our legal system knows acts of last will different from the will, coming to affirm that, beyond the expressly regulated hypotheses, me person can entrust to an act of last will different from the will any post mortem interest that do es not affects the delation. It therefore comes to affirm that the prohibition of the succession agreement concerns only the acts of disposition of the delation and that the acts of last will can regulate all interests orher than those that affect the delation.
