El presente artículo tiene por objetivo analizar cómo las organizaciones internacionales han ido adquiriendo y se les ha ido reconociendo progresivamente personalidad jurídica en la sociedad internacional. El carácter evolutivo del proceso de conformación de las organizaciones internacionales obliga, necesariamente, a profundizar en las aportaciones que en relación con este fenómeno se hicieron a lo largo del siglo XIX y principios del siglo XX, sobre todo en los continentes europeo y americano. Así, será durante este periodo histórico y en estas regiones del planeta donde podemos situar no solo la aparición de las primeras organizaciones internacionales, sino también la formación de personalidad jurídica de las organizaciones internacionales. Para desarrollar este estudio se ha utilizado la metodología propia del Derecho y de las Relaciones Internacionales. De este modo, se han analizado tanto las posiciones doctrinales de los iusinternacionalistas en esta materia como los pronunciamientos jurisprudenciales de los principales órganos internacionales.
The aim of this article is to analyze how international organizations have been acquiring and progressively recognizing their legal personality in international society. The evolutive character of the process of conformation of the International Organizations requires, necessarily, to deepen into the contributions that were made in relation to this phenomenon throughout the 19th century and the beginning of the 20th century, especially in the European and American continents. Thus, it will be during this historical period and in these regions of the planet where we can place not only the appearance of the first international Organizations, but also the formation of juridical personality of the International Organizations. To develop this study, the methodology of Law and International Relations has been used. In this way, both the doctrinal positions of the iusinternacionalistas in this matter and the jurisprudential pronouncements of the main international bodies have been analyzed.
