La era digital ha supuesto la ruptura entre la frontera clásica de tiempo de trabajo y descanso. Ese desproporcionado sometimiento de permanente conexión vulnera el derecho a la conciliación de la vida familiar y da lugar a la aparición de nuevos riesgos psicosociales que afectan a la salud de los empleados públicos. Por ello algunos Estados miembros de la Unión Europea, como Francia y posteriormente Italia han procedido a su regulación. El Reino de España ha procedido a la reciente regulación normativa del derecho a la desconexión digital, de forma tangencial al derecho a la protección de datos en la LO 3/2018, de 5 de diciembre, reconociendo expresamente el derecho a la desconexión digital, añadiendo una nueva letra j bis) en el artículo 14 del EBEP. La norma delega en la negociación colectiva su desarrollo para garantizar su cumpliento. Sin embargo, sería conveniente el reconocimiento expreso del derecho a la desconexión digital en la Ley de Prevención de Riesgos Laborales. También sería recomendable y necesario contemplar este deber empresarial en la Ley de Infracciones y Sanciones del Orden Social para conseguir garantizar su cumplimiento. Es necesario establecer el medio para ejercer el derecho a la desconexión que se deberá regular por cada Administración Pública en sus normas de gestión de personal, es decir, por medio de convenios y pactos. Por último, también es necesario reflexionar sobre las oportunas acciones de formación, concienciación y sensibilización sobre el correcto uso de los medios digitales.

It is necessary to establish the means to exercise the right to disconnection that should be regulated by each Public Administration in its personnel management rules, that is, by means of agreements and pacts. Finally, it is also necessary to reflect on the opportune actions of training, awareness and awareness about the correct use of digital media.
