Recurriendo a la historia legislativa de Chile, a su legislación actual y a los preceptos de la Constitución vigente, este artículo arguye que, desde el punto de vista jurídico, no se puede considerar al que está por nacer como una persona. This article argues from Chile’s legislative history, from the laws now in force and from the precepts of the current constitution that the unborn cannot legally be regarded as a person. Upholding this doctrine would not only entail an incomplete reading of legal texts but would jeopardize the harmony between the laws and the constitution, as indeed has recently been acknowledged by Chile’s Constitutional Court.
