En el presente artículo se abordará inicialmente el catálogo de derechos político-electorales expresados en la Constitución Política de los Estados Unidos Mexicanos y los desarrollados jurisprudencialmente, para indicar, de manera general, las funciones de cada poder tradicional y de los órganos constitucionalmente autónomos, así como los mecanismos por los cuales sus actos, las reglas o las omisiones son revisables en el ámbito materialmente jurisdiccional, es decir, no precisamente por órganos del Poder Judicial, sino por órganos que ejercen funciones judiciales formalmente vinculadas al Poder Ejecutivo, al Legislativo o al cuerpo constitucionalmente autónomo. Finalmente, se destacará la ausencia de instrumentos de revisión materialmente judicial en los procedimientos de juicio político y declaración de origen llevados ante el Legislativo, y cómo la falta de previsión afecta los derechos político-electorales de los servidores públicos sometidos a dicha instancia
In this article, the catalog of political-electoral rights expressed in the Political Constitution of the United Mexican States and those developed jurisprudentially will be addressed initially, to indicate, in a general way, the functions of each traditional power and constitutionally autonomous bodies, as well as the mechanisms by which their acts, rules or omissions are reviewable in the materially jurisdictional sphere, that is, not precisely by organs of the Judicial Power, but by bodies that exercise judicial functions formally linked to the Executive, the Legislative or the constitutionally autonomous body. Finally, it will be highlighted the absence of materially judicial review instruments in the procedures of impeachment and declaration of origin brought before the Legislative, and how the lack of foresight affects the political-electoral rights of public servants submitted to said instance
