La STC 137/2018, de 13 de diciembre, declara inconstitucional por contrariar la normativa básica en materia de régimen local el precepto autonómico de la Ley de capitalidad de Zaragoza que otorgaba al Gobierno de la ciudad la for-mación de la voluntad de sus sociedades de capital íntegramente municipal. En este artículo comento la STC y analizo, después, tanto los controles democrá-ticos a la formación de la voluntad de los entes instrumentales locales, como otras leyes de capitalidad y la ausencia de referentes previos en esta cuestión.
The judgment by the Spanish Constitutional Court no. 137/2018, of Decem-ber 13th, has declared unconstitutional the provision set out in a regional Act of declaration of a Capital City allowing the government of that city to rule by itself and without any enquiry of the council its companies, given the fact that it contradicts the State’s Basic Local Act. I also comment on the demo-cratic formation of the public companies will and how other similar acts have not regulated this issue in the same way.
