The reflections outlined here deal with the illegitimacy of the process of impeachmentin Brazilian presidentialism following the process of removal of President Fernando Collor de Melo in 1992. From the point of view of the legitimacy theory as a concreteconflict of positive law proposed by Friedrich Müller, The article deals with the following hypothesis: the process of presidential destitution as established today in Brazilian presidentialism does not materialize the text of the Constitution of the Federative Republic of Brazil of 1988, given its regulation in predecessor law that had an analysis of inadequate constitutional filtering twice by the Federal Supreme Court during the current Republic. The study is structured in three bases: the way in which the impeachmentin Brazilian presidentialism is structured; the theory of legitimacy as a concrete conflict in positive law; and the verification of (i) the legitimacy of the presidential recall process in Brazilian constitutional engineering from the precedentCollor. There is a serious breach in the structural conception of the powers of the Republic and, above all, of the democratic regime, by allowing a poorly regulated process to lead to the handling of illegitimate impeachmentsagainst democratically elected rulers, in violation of Brazilian constitutional supremacy
As reflexões aqui tracejadas se debruçam sobre a ilegitimidade do processo de impeachment no presidencialismo brasileiro a partir do processo de destituição do Presidente Fernando Collor de Melo em 1992. Sob a ótica da teoria da legitimidade como conflito concreto do direito positivo proposta por Friedrich Müller, o artigo tem como cerne a seguinte hipótese de trabalho: o processo de destituição presidencial como estabelecido hoje no presidencialismo brasileiro não concretiza o texto da Constituição da República Federativa do Brasil de 1988, dada sua regulamentação em lei predecessora que tivera análise de filtragem constitucional inadequada duas vezes pelo Supremo Tribunal Federal durante a atual República. O estudo estrutura-se em três bases: a forma como está estruturado o impeachment no presidencialismo brasileiro; a teoria da legitimidade como conflito concreto no direito positivo; e a verificação da (i)legitimidade do processo de destituição presidencial na engenharia constitucional brasileira a partir do precedente Collor. Identifica-se uma grave brecha na concepção estrutural dos poderes da República e, sobretudo, do regime democrático, ao se permitir que um processo parcamente regulamentado enseje o manejo de impeachments ilegítimos contra governantes democraticamente eleitos, violando a supremacia constitucional brasileira.
