O artigo trata das controvérsias em torno da interpretação do artigo 139, IV, do CPC sob a perspectiva do modelo constitucional de processo. Busca-se verificar se a redação do novo dispositivo legal autoriza que medidas coercitivas sejam criadas de modo discricionário pelos órgãos jurisdicionais, ancorados em princípios de proporcionalidade e razoabilidade e, em caso afirmativo, se essa é uma leitura adequada considerando os fundamentos do Estado Democrático de Direito.
This article deals with the controversies surrounding the interpretation of article 139, IV, of the CPC from the perspective of the constitutional model of the process. The aim is to verify whether the wording of the new legal provision authorizes coercive measures to be created in a discretionary manner by the courts based on principles of proportionality and reasonableness and, if so, whether this is an appropriate reading considering the foundations of the Democratic State of Right.
