En este trabajo se examinan los diversos conceptos sobre presunción e indicio que han sido expuestos por la doctrina, la jurisprudencia y el derecho positivo, indicando la concepción prevaleciente, mostrando el aporte de Manuel Serra Domínguez. Se analiza los fundamentos que sustentan el concepto sobre la presunción y el indicio y sus relaciones. Se formula crítica al concepto unitario de presunción debido a que no es adecuado de las diferentes formas de presunción que se aplican en el proceso judicial y se formula un concepto de indicio. El presente estudio trata el concepto de presunción e indicio como universals. Este escrito forma parte de la investigación propiciada por la Fundación Manuel Serra Domínguez sobre actualización de la doctrina de Manuel Serra sobre la presunción.
This paper examines the various concepts on presumption that have been exposed by the doctrine, jurisprudence and positive law, indicating the prevailing conception, showing the contribution of Manuel Serra Domínguez. The foundations that support the concept of presumption and its relationship with the typologies established in various legal systems are analyzed. The unitary concept of presumption is criticized because it is not adequate for the different forms of presumption that are applied in the judicial process. The present study deals with the concept of presumption as universal. This writing is part of the research promoted by the Manuel Serra Domínguez Foundation on the updating of the Manuel Serra doctrine on presumption.
