Explicación y comentario del conflicto surgido entre el Estado y las Comunidades Autónomas de Aragón, Galicia y Cataluña, por la competencia sobre la concesión de almacenamiento geológico de dióxido de carbono, con particular atención a los planteamientos aragoneses. La Ley 40/2010 atribuyó a la Administración estatal la tramitación de este procedimiento con base en su importancia para la planificación general de la economía (art. 149.1.13 CE). Sin embargo, la doctrina y entes regionales criticarían esta decisión argumentando la vulneración de las competencias autonómicas de gestión en materia de protección ambiental y minería. Finalmente, la STC 165/2016, de 6 de octubre, declararía conforme al texto fundamental la centralización del acto ejecutivo, no en virtud del título económico si no a través de las bases del régimen minero (art. 149.1.25).
Explanation and commentary of the conflict between the Spanish state and the regional governments of Aragon, Galicia and Catalonia over the competency of issueing permits for geological storage of carbon dioxide, with special focus on the Aragonese position. The Act 40/2010 gave the Spanish Administration the right to start this procedure due to its impact on the general planning of the economy of the country. However, the specialists and the local governments criticized this decision on the grounds that it damaged the regional executive competency in questions of environmental protection and mining. Finally, a Constitutional Court resolution established that the State competency of this centralized administrative act complies with the Spanish Constitution, not on the basis of the economy but of mining itself.
