En principio parecerían aspectos solo de semántica o de forma; por lo que se creería que es lo mismo decir “Acción POR Incumplimiento” y “Acción DE Incumplimiento”; pero en realidad son dos acciones que, si bien están en la esfera constitucional, son diferentes y de naturaleza distinta, aunque para resolver las dos acciones es competente la Corte Constitucional del Ecuador. Lastimosamente no existe mucha doctrina especializada al respecto o incluso algunas publicaciones escritas o audiovisuales en lugar de aportar certezas o mayor claridad podrían generar más bien confusión. En el presente artículo, intentaré de manera didáctica, pero no por ello menos precisa, señalar las diferencias de cada una de dichas Acciones, sin perjuicio de evidenciar aspectos que aún con dicho esfuerzo de precisión, pueden generar debate e incluso contradicción, esto debido sobre todo a que, en las primeras sentencias constitucionales, la propia Corte utilizaba de manera indiscriminada las palabras “de” o, “por” como sinónimos constitucionales. En todo caso, como resumen de la cuestión a tratarse podemos señalar que la Acción POR Incumplimiento es una Garantía Jurisdiccional, que la considero de carácter especial y que se la interpone para lograr: 1) garantizar la aplicación de las normas que integran el sistema jurídico ecuatoriano, o de los actos administrativos de carácter general; 2) así como el cumplimiento de sentencias o informes emitidos por organismos internacionales de derechos humanos; mientras que la Acción DE Incumplimiento, se presenta: 1) de manera subsidiaria en el caso de inejecución o defectuosa ejecución de sentencias constitucionales emitidas por Jueces en el Ecuador; y, 2) en el caso de incumplimiento de sentencias y dictámenes emitidos por la Corte Constitucional del Ecuador. La acción de Incumplimiento que, por decisión de la Corte Constitucional, fue elevada a la categoría de Garantía Jurisdiccional, busca:
1) Hacer efectiva la sentencia incumplida; y, 2) La reparación integral de los daños causados al solicitante.
In principle they would seem just semantical or formal aspects, so it would be believed that “Action FOR non-compliance” and “Action OF non-compliance” are the same. But the truth is that these actions are different and they have a different nature, although both of them are in the constitutional sphere and the competent body to rule on them is the Constitutional Court of Ecuador. Unfortunately there isn’t much specialized doctrine on the matter, and some of the written or audiovisual papers could create confusion instead of bringing certainty or more clarity. This paper will try to point out the differences between these actions in a didactic but not less accurate way, without prejudice to highlighting some aspects that could generate debate or even contradiction despite the aforementioned effort of accuracy. This is due to the fact that the Court used the words “of” or “for” indiscriminately in the first constitutional judgements, as constitutional synonyms. In any case, as a summary of the issue we can point out that the action FOR non-compliance is a jurisdictional guarantee, which has special character and it is brought to: 1) ensure the application of the rules of the Ecuadorian legal system, or the general administrative acts; 2) as well as the compliance with the judgements or reports issued by international human rights bodies. On the other hand, the action OF non-compliance is used: 1) in a subsidiary way in case of nonexecution or defective execution of constitutional judgements ruled by judges in Ecuador; and 2) in case of non-compliance with judgments and opinions issued by the Constitutional Court of Ecuador. The action of non-compliance, which has been raised to the category of jurisdictional guarantee by the Constitutional Court, seeks to: 1) give effect to the breached judgment; and 2) the complete reparation of the damages which have been caused to the complainant
