Los delitos de peligro son figuras a las que por múltiples razones técnicas y político-criminales recurre con frecuencia cada vez mayor el legislador punitivo moderno y coherentemente con tal tendencia, ha ido creciendo al mismo tiempo la atención que le dedica la doctrina científica y la jurisprudencia. Con nuestro análisis del largo devenir histórico de la actio de positis vel suspensis tratamos de demostrar que ni la existencia, ni el concepto de los delitos de peligro son una creación del legislador y de la doctrina contemporánea; muy al contrario, los juristas romanos aceptaron sin objeciones la división entre delitos de daño o lesión y delitos de peligro, tomando como base el grado de energía en la acción que provoca el bien jurídico protegido. Si el resultado produce la destrucción de un bien o de un derecho, estamos en presencia de un delito de daño; si sólo alcanza la posibilidad de producirlo, nos hallamos ante un delito de peligro, tal cual acontece con la actio de positis vel suspensis.
The crimes of endangerment are figures which for multiple technical and political-criminal reasons the penal modern legislator often resorts and coherently with such a trend the attention has been growing simultaneously. This attention that dedicates the scientific doctrine as well as the jurisprudence. With our analysis of the length historical development of the actio de positis vel suspensis, we try to prove that neither the existence nor the concept of crimes of danger are a creation of the legislator and the contemporary doctrine; the very opposite, the Roman jurists accepted without objections the division between crimes of damage or injury and crimes of endangerment, talking the degree of energy as a base in the action that provokes the determination of the juridical protected good. If the result destroys a good or right, we are in presence of an offence of damage. If only it reaches the possibility of producing it, we are situated before a crime of endangerment as it happens in the actio de positis vel suspensis.
