Tax regularization during the “fifth year” allows the taxpayer to avoid criminal punishment for tax fraud, which would otherwise apply. But this regularization is unenforceable from a strictly tax perspective, having passed the prescriptive four-year period for claiming the tax debt. Experts have yet to discuss the legal basis that makes it possible to regularize the “fifth year”. This study raises the possibility that the spontaneous regularization of the “fifth year” is understood as an advance of the civil liability ex delicto determined by the criminal courts.
