Este artículo analiza principalmente el control parlamentario del Gobierno en funciones a la luz de la STC 124/2018, de 14 de noviembre, que resuelve el conflicto entre órganos constitucionales del Estado (núm. 3102-2016), promovido por el Congreso de los Diputados tras el rechazo de comparecencia urgente del Ministro de Defensa en funciones. El comentario de la sentencia constituye el núcleo del artículo, si bien va precedido, a modo de introducción, de un breve estudio sobre el Gobierno en funciones. Se trata, en definitiva, de definir qué es el Gobierno en funciones para, a partir de ahí, y a la luz de la STC 124/2018, examinar si se puede someter, y en qué medida, al control parlamentario que los artículos 66.2 y 108 y ss. CE atribuyen a las Cortes Generales.
This article mainly analyzes the parliamentary control of the caretaker Government in accordance with the judgment by the Constitutional Court (No. 124/2018), Novembre 14th. The study focuses on the judgment by the high court, although it is preceded, as a preface, by a brief study of the caretaker Government. Once defined what the acting government is, the study focuses on parliamentary control of the caretaker Government in accordance with declared by the judgment of the Constitutional Court.
