El presente artículo reflexiona acerca de la Transparencia del Estado, en específico, del Derecho de Acceso a la Información Pública, como condición necesaria para el control ciudadano de la actividad estatal en la defensa de intereses tanto colectivos como individuales, y su legitimación enfocada particularmente a partir de la Servicialidad del Estado. Lo anterior, en miras de indagar no sólo en el ámbito social y político de este Derecho Fundamental, concebido tradicionalmente a partir del Principio Democrático y la participación social centrada en la defensa de intereses superiores, sino también enfocándose en la faz individual de éste, la cual posibilita la defensa de intereses particulares diversos.
This article reflects on State Transparency, specifically, regarding the Right of Access to Public Information as a necessary condition for citizen control of state activities, in defense of both collective and individual interests, and its legitimacy focused particularly from the State service. The Right of Access to Public Information as mentioned earlier, aiming to investigate not only the social and political scope of this Fundamental Right, traditionally conceived from the Democratic Principle and social participation focused on the defense of higher interests, but also converging on the individual side of it, allowing the defense of different interests.
