El presente artículo pretende poner de manifiesto que nuestro ordenamiento constitucional está configurado en la línea de pensamiento de una tradición personalista (moderada) que admite dañar instrumentalmente, incluso cuando está en juego el contenido esencial de los derechos fundamentales más básicos, siempre que se cumplan dos requisitos: que la injerencia se verifique regularmente (cumpliendo con las exigencias ponderativas correspondientes al rango axiológico del derecho afectado) y que el coste económico del daño sea debidamente equidistribuido (a través de la correspondiente indemnización).
This article aims at showing that our constitutional order is set following a (moderated) personalist line of though, which admits to instrumentally produce damages, even when the core content of the most fundamental rights is in play but always when two requisites are met: the interference should be regularly verified (meeting the weighting requirements related to the axiological rank of the affected right) and the economic cost of the damage would be equally distributed (with the corresponding compensation).
