Las sentencias de la Corte Interamericana de Derechos Humanos tienen efectos erga omnes, por lo que son vinculantes para todos los países miembros de la Convención Americana sobre Derechos Humanos, suscrita en la Conferencia Interamericana Especializada sobre Derechos Humanos en San José, Costa Rica en noviembre de 1969, y esta conclusión se deriva también del análisis de los principios derivados del artículo 107 de la Constitución de los Estados Unidos Mexicanos, específicamente la instancia de parte agraviada, agravio personal y directo, estrechamente ligada a la de la relatividad. Bajo la fórmula Otero de "dichos tribunales se limitan a dar su protección en el caso particular en relación con el proceso, SIN HACER CUALQUIER DECLARACIÓN GENERAL conformidad con la ley o la acción motivándolo"
The judgments of the Inter-American Court of Human Rights have erga omnes effects, and therefore they are binding for all countries members of the American Convention on Human Rights, signed in the Inter-American Specialized Conference on Human Rights in San José, Costa Rica in November 1969, and this conclusion derives also from the analysis of the principles derived from article 107 of the Constitution of the United Mexican States, specifically the instance of aggrieved party, personal and direct grievance, closely linked with that of relativity.
