El derecho al olvido está garantizado por la LOPD. No obstante, su ejercicio será diferente en función de si la información es accesible a través de los motores de búsqueda de internet o de las redes sociales. A continuación, se analizará si esta divergencia puede suponer una mayor censura cuando este derecho conlleva la libertad de borrar cualquier información aportada por el interesado en las redes sociales o si la libertad de borrado es una consecuencia lógica derivada de su libertad de aportación.
According to Spanish law, the right to be forgotten is guaranteed by the LOPD. However, its exercise may vary depending on whether the information is available via Internet search engines or through social networks. Therefore, this article will analyze whether this divergence can produce a greater censorship when the right to be forgotten entails the right to erase any information contributed on social networks by interested parties, or if the right to erasure is a logical consequence derived from their freedom of contribution.
