The assets registered in the name of the spouse who is innocent of the crime may be subject to preventive seizure aimed at value confiscation if the suspect has the availability, understood as an effective relationship with the property as owner. In case of legal community of property, such availability is assumed and 50% of the asset value will be subject to the seizure ordered against the suspect. Whereas, in case of separation-of-property system between the spouses, it will be necessary to prove that the property is concretely available to the suspect, even if formally registered in the name of the spouse.
I beni intestati al coniuge estraneo al reato possono essere oggetto di sequestro preventivo finalizzato alla confisca per equivalente qualora l’indagato ne abbia la disponibilità, intesa quale relazione effettuale con il bene uti dominus. In caso di comunione legale dei beni, tale disponibilità si presume e oggetto del sequestro disposto nei confronti dell’indagato sarà il 50% del valore del bene; se tra i coniugi vige il regime di separazione dei beni, invece, occorrerà dimostrare che il bene è nella disponibilità concreta dell’indagato, ancorché intestato formalmente al coniuge.
