El anonimato con el que es posible actuar en Internet puede representar un obstáculo para el derecho a la tutela judicial efectiva, en cuanto se desconoce la identidad del sujeto contra quien presentar la demanda. Consciente de esto, el legislador español ha introducido en el art. 256.1 de la LEC una diligencia preliminar dirigida a obtener la identidad del prestador de servicios –intermediario o proveedor de contenidos- que está infringiendo derechos de propiedad industrial o intelectual en la Red. El presente trabajo tiene por objeto el examen de este instrumento pre-procesal, estableciendo los aspectos principales de su régimen jurídico cuando se pretende la protección de los derechos de propiedad intelectual que han sido infringidos en Internet.
The anonymity with which it is possible to conduct activities on the Internet can represent an obstacle to the right to an effective legal protection, inasmuch as the identity of the person against whom file the lawsuit is unknown. Being aware of that, the legislator has introduced in the art. 256.1 of the Spanish Civil Procedure Act a preliminary proceeding aimed at discovering the identity of the information society service provider –intermediary or content provider- that is infringing intellectual property rights on the Net. This paper aims to examine the pre-trial proceeding by setting the main characteristics of its legal regime when the protection of copyrights infringed on the Internet is requested.
