En el presente trabajo pretendemos elaborar un breve comentario a una reciente sentencia del Tribunal Supremo, Sala 3.', Sección 5.' 2546/ 2018, de 9 de julio. A lo largo del trabajo, intentaremos demostrar que, por un lado, la reubicación de un alto número de solicitantes de asilo procedentes de Italia y Grecia que corresponde a España y que aún no ha sido ejecutada constituye un incumplimiento del Derecho Europeo, y por otro, que corresponde al órgano judicial nacional que controla la actividad administrativa de ejecución de esas obligaciones emanadas del Derecho Europeo el enjuiciamiento y condena del Estado Español por su incumplimiento.
Tal incumplimiento de Derecho Europeo se fundamenta en la inejecución de dos Decisiones, la 2015/ 1523 Y la 2015/1601, Y ha sido asi declarada por el Tribunal Supremo en la sentencia objeto de comentario.
Como tal, proponemos la presente sentencia como ejemplo de actuación del Juez nacional en la aplicación del Derecho Europeo
In the present work we try to elaborate a brief commentary on a recent case of the Spanish Supreme Court, 3rd Chamber, Section 5th 2546/2018, 9th July. Through this work we will try to show that, on the one hand, relocation of a high number of asylum seekers coming from Italy and Greece and correspondent to Spain, which has not yet been executed, constitutes a failure to fulfil with European Law. And, on the other hand, that it is a task for the national Judge to control the administrative action of the member State on the execution of European obligations, as well as the judgment and control of this unfulfilment.
In this case, unfulfilment of European Law derives from Decisions 2015/1523 and 2015/1601, and has been so declared by the Spanish Supreme Court in the case on which we are making a commentary here. Given this fact, we propose this case as an example of a decision of a national court as an European Judge on the application of European Law.
