El principio de justicia universal ostenta como bien jurídico protegido los intereses de la comunidad internacional y, se emplea como instrumento de lucha contra los crímenes internacionales, su previsión en las normas de derecho internacional se contempla como una facultad por parte de los Estados, no obstante, determinados convenios combinados con la regla aut dedere aut iudicare, en la vertiente en la que prima el enjuiciamiento, imponen a los Estados firmantes la obligación de enjuiciar a los presuntos responsables cuando éstos se encuentren en su territorio.
En el presente trabajo se realiza una comparativa de la normativa internacional con la española en lo que respecta a la justicia universal, así como con los convenios en los que España ha prestado su consentimiento, y se ponen de manifiesto determinados aspectos en que la normativa española, en su artículo 23 de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial, no se adecúa a estas normas internacionales. Para comprender tal situación, resulta imprescindible analizar las distintas fases que ha sufrido el principio con motivos de las distintas reformas del mismo, así como de las circunstancias que han propiciado tales reformas.
The principle of universal justice has the interests of the international community as a protected legal asset and is used as an instrument to fight against international crimes, its foresight in the norms of international law is seen as a faculty on the part of the States, nonetheless , certain agreements combined with the rule aut dedere aut iudicare, in the aspect in which prosecution prevails, impose on the signatory States the obligation to prosecute the alleged perpetrators when they are in its territory.
In the present work a comparison of the international norms with the Spanish one is made with respect to the universal justice, as well as with the agreements in which Spain has given its consent, and certain aspects are revealed in which the Spanish regulations , in its article 23 of the Organic Law 6/1985, of July 1, of the Judicial Power, does not adapt to these international norms. To understand this situation, it is essential to analyze the different phases that the principle has suffered with reasons for the different reforms of the same, as well as the circumstances that have led to such reforms.
