Se procura hacer ver que «populisno» y «garantismo» constituyen unas etiquetas con magro alcance esclarecedor, antes bien son desorientantes, en la doctrina del derecho penal. Ambas resultan inocuas, cuando no engañadoras, para poder guiar con lucidez –esto es, ¡empírico-científicamente!– hacia soluciones prácticas socialmente adecuadas en este campo.
This article seeks to show that “populism” and “criminal guarantees” are labels with a limited clarifying scope. On the contrary, they are befuddling in criminal law doctrine. Both are innocuous, but they can be also be dangerous in order to furnish a lucid guide, that is empirically-scientifically, for practical solutions that may be appropriate to this field
