Las universidades públicas realizan una intensa actividad internacional, plasmada fundamentalmente a través de convenios internacionales con otras instituciones de educación superior extranjeras. Sin embargo, dicha actividad internacional nunca ha estado debidamente juridificada: ni está clara la naturaleza jurídica de dichos convenios, ni tampoco el régimen jurídico al que se someten. La aprobación de la Ley 25/2014, de Tratados y otros Acuerdos Internacionales, ha tratado de establecer el régimen jurídico de los acuerdos internacionales (no tratados) celebrados por órganos u organismos sujetos de Derecho Internacional, lo que incluye a las universidades. El presente trabajo analiza, precisamente, la aplicación de dicha ley a las universidades públicas españolas.
Public Universities are internationally very active. Their international activity is mainly based on the signing of international agreements with foreign institutions of higher education. However, this international activity has never been properly codified and the legal nature of these agreements remains unclear. The Spanish Parliament has recently passed a Law on international Treaties and other kind of international Agreements, whose aim is to clarify the legal regime of international agreements that are not international treaties and can, therefore, be signed by administrative bodies and public entities (including public Universities). This paper focus on how the aforementioned Law can be applied to the international agreements signed by public Universities.
